Edwards Agenda Public Works Director/ <br />Public Works Director/City Engineer Section: City Engineer's Report <br />Purpose. The purpose of this action item is to gain Council authorization to begin developing a City <br />Americans with Disabilities Act (ADA) Transition Plan. <br />1. Background. The City of Orono does not have an ADA Transition Plan. All local Governments are <br />required to meet the general requirements of Title 11 of the American Disabilities Act (ADA). To <br />accomplish this they are required to conduct a Self -Evaluation of all programs; policies/procedures; <br />maintenance practices; and infrastructure; and identify those that are inconsistent with current ADA <br />Standards. In addition, local governments are required to develop a Transition Plan which: <br />• Summarizes the Self -Evaluations results, <br />• Identifies items that are not in compliance with current ADA Standards; and <br />• Details how the organization will bring inconsistent items into compliance with current ADA <br />Standards and ensure that they are accessible to all individuals. <br />The Americans with Disabilities Act (ADA), enacted on July 26, 1990, is a civil rights law <br />prohibiting discrimination against individuals on the basis of disability. Title 11 of ADA pertains to the <br />programs, activities and services that public entities provide. Title 11 of ADA provides that, "...no <br />qualified individual with a disability shall, by reason of such disability, be excluded from participation in <br />or be denied the benefits of the services, programs, or activities of a public entity, or be subjected to <br />discrimination by any such entity." (42 USC. Sec. 12132; 28 CFR. Sec. 35.130) As a provider of public <br />transportation services and programs, the City of Orono must comply with this section of the Act as it <br />specifically applies to local governments. <br />2. Project Scope. The development of the transition plan will include: Data Collection and Analysis of <br />existing transportation and access features, facilitation of public involvement and input in to the process, <br />Self -Evaluation/ analysis of the data collected and input received, the writing of the Transition Plan, and <br />the incorporation of the data collected into the cities asset management system. <br />3. Cost. Bolton and Menk provided a not to exceed estimate (NTE) of $9,624 for the assessment <br />(Exhibit A). <br />4. Funding. The assessment will be funded by the Engineering Line of the Operating Budget which has <br />a 2017 budget of $20,000. <br />5. Staff Recommendation. I recommend the council accept the proposal from Bolton and Menk to <br />facilitate the development of an ADA Transition plan. <br />COUNCIL ACTION REQUESTED <br />Motion to accept BMI's proposal of NTE $9,624 to facilitate the development of Orono's ADA transition <br />Plan. <br />Exhibits <br />A.
