Mattick indicated the State is not bound by the passage of a law unless the words of the act
leave no doubt as to the intention of the legislature.
Mattick stated this is not an uncommon issue for cities but that different communities have had success in
approaching the state and notifying them when there is a problem. Mattick stated it is a little different
when it is located on private property and that the contractor is required to follow certain City regulations.
Mattick noted Senator Osmek has provided the contact at X1N/D0T if there is a problem with the
Highway 12 project.
Walsh stated the City could reach out and find out what restrictions are being placed on the contractor in
the event a citizen has a complaint.
