MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, April 10, 2017 <br />7:00 o'clock p.m. <br />23. #17-3924 CITY OF ORONO, TEXT AMENDMENT: REPEAL OF CONDITIONAL USE <br />PERMIT — ORDINANCE NO. 192, Third Series (Continued) <br />Mattick stated it would be a lot easier if it was as simple as knocking on the say and saying I am <br />inspecting, but it is not that simple. Mattick noted this very issue is before the Supreme Court right now <br />about what it takes to enter someone's property in the context of apartment rentals. Mattick stated he is <br />not aware of anything that allows the City to enter someone's property if they are denied entry. <br />Mattick stated in light of what is before the Supreme Court currently, if the Supreme Court changes the <br />rules, the City will be back revising this again. Mattick stated the language is just simply meant to be a <br />reflection of what the law is currently. <br />Seals asked if Mr. Johnson has concerns about the marina next to him not following their conditional use <br />permit. <br />Johnson stated the conditional use permit for the marina is very well written but not all conditional use <br />permits are well written and some are not enforced. <br />Seals moved, Crosby seconded, to adopt ORDINANCE NO. 192, Third Series, an Ordinance <br />Amending the Code of Ordinances Pertaining to the Review of Conditional Use Permits Upon <br />Neighbors Petition. VOTE: Ayes 5, Nays 0. <br />24. #17-3926 CITY OF ORONO, TEXT AMENDMENT: EXEMPTION FOR <br />GOVERNMENT SIGNS — ORDINANCE NO. 193, Third Series <br />Barnhart stated this is an ordinance that attempts to give governments the ability to erect signs on their <br />properties for government purposes. Currently City Code prevents signs from being erected by the City, <br />Hennepin County, and/or the State of Minnesota in the rights -of -ways, such as regulatory signs. This <br />ordinance attempts to clarify that government signs are exempt from the sign code. <br />Barnhart noted this issue came to Staff's attention by the Hennepin County Water Patrol. The Water <br />Patrol has identified a goal to install public service signs on the bridges. During the review process, Staff <br />realized the City had nothing to regulate those signs and technically they are prohibited. This ordinance <br />will allow signs for government agencies to be placed within the right-of-way. <br />Page 20 of 26 <br />
