"The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code." <br />The proposed changes to the property will not impair health, safety, comfort, morals or be <br />contrary to the intent of the current zoning ordinances. Means and methods of construction will <br />be specified to protect the existing property and maintain its current condition. Best practices will <br />be used to ensure that soils are not disturbed, that the floodplain is not impacted by the work, <br />and that all means to protect the delineated wetland and shoreline will be used. <br />12. "The granting of such variance wilt not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable difficulty." <br />The granting of the variance from the average lakeshore setback does not constitute a <br />convenience for the property owner. A significant portion of the property is impacted by the <br />practical difficulties described above. The ability to replace a failing, existing structure on the <br />property will be aided by the granting of a variance to allow for the construction of a new <br />structure in the same location. By constructing the new structure in the same location, the impact <br />of the construction will be minimal and the remainder of the property can be maintained in its <br />current condition. <br />
