6. Improvements: in accordance with the policies and ordinances of the City, the <br />following described public or private improvements (hereinafter collectively called the <br />"Improvements") shall be constxWed, installed and maintained by the Developer <br />according to the terms and conditions contained in this Agreement: <br />A. Site grading, roadways and driveways, curb and gutter, panting lots, sidewalks, <br />retaining walls and all necessary erosion control measures per the approved <br />Grading and Drainage Plea (hereinafter called "site grading improvements'); <br />B. Construction of sanitary sewer and water connections, and construction of storm <br />sewer lines and facilities as required (hereinafter called "stormwater <br />improvements') per the Utility Plan referenced herein. A drainage and utility <br />easement shall be dedicated over entire Lot 5 as part of the final plat. <br />C. Underground natural gas, electric, cable and telephone service to be arranged by <br />the Developer with the utility companies involved (hereinafter called the "other <br />utility improvements"); <br />D. Landscaping and site revegetation improvements per the approved Landscape <br />Plan referenced herein (hereinafter called "landscaping improvements'). <br />E. Traffic control signage subject to approval by the City Engineer and Public <br />Services Director. <br />F. Any additional improvements listed within the Site improvements Cost Estimate <br />attached hereto as Exhibit A (the "Estimate"). <br />7. Construction of Improvements <br />A. Commencerment Date — Constriction of Improvements shall begin no later than <br />E. Completion slate — All Improvements shall be completed no later than <br />.�% K'd. f '30 <br />47401 (2 years after start date). The Developer may, <br />however, request an extension of time from the City. If an extension is granted, it <br />shall be conditioned upon updating the security posted by the Developer to reflect <br />cost increases and the extended completion date. <br />C. o rs -- The Developer shall select, retain and supervise the contractor(s) <br />responsible for construction of the Improvements. The City reserves the right to <br />require satisfactory proof of successful experience and adequate financial status of <br />each such contractor. Where required by City ordinance, the contractor shall first <br />obtain a license from the City. <br />D, Pre -Con- ruction Conference — Prior to the start of any construction, the <br />Developer and the developer's contractor shall meet with the responsible City <br />officials to review construction plans and schedules, <br />Developer Initial 94 <br />City Clerk lnldalIW— <br />Page 4 of 9 <br />
