The proposed plans are as provided to the <br />Planning Commission, annotated as PC Exhibits C and D, and in the resolution as Exhibits A and B. <br />A verification of the compliance of a septic system is required as part of a land sale. The current system is <br />non-compliant, and needs to be replaced. Two sites must be identified for each property in Orono. The <br />applicant was only able to identify one treatment site; the replacement system will be installed at this <br />location. The City Code provides the Building Official with the authority to grant variances from the septic <br />code requirements. In this situation the Building Official has recommended that the City Council review and <br />rule on the requested septic variance. His recommendation for approval of the variance is attached. The <br />Council is asked to confirm the variance, which is necessary due to the existing configuration of the property, <br />and the location of the wetlands. <br />Planning Commission Recommendation <br />On February 21, the Planning Commission held a public hearing and reviewed the application including the <br />evidence submitted. Following the public hearing the Commission voted 6 to 0 in favor on a motion to <br />approve the setback variance. The Planning Commission also recommended that there be some form of <br />notification to future property owners regarding the status of the septic system. Staff included language <br />regarding the septic variance in the approval resolution for this purpose. <br />Planning Staff Recommendation <br />Staff recommends approval of both variances. A draft approval resolution regarding the setback variance has <br />been provided for Council's consideration. Staff recommends placing a memo in the City's property file <br />detailing the septic system limitations on the property. <br />COUNCIL ACTION REQUESTED <br />Council should make a decision on both the septic variance and the setback variance.
