CITY OF ORONO Exhibit E <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION <br />AMENDING RESOLUTION NO. 6613 <br />REGARDING VARIANCES GRANTED FOR <br />PROPERTY LOCATED AT 1700 BOHN'S POINT ROAD <br />— FILE NO. 16-3814. <br />WHEREAS, on April 25, 2016 the Orono City Council via Resolution No. 6613 <br />granted certain variances, including an average lakeshore setback variance, to allow construction of <br />a new residence on property owned by Peter A. Santrach and Melissa A. Kreimer Santrach, husband <br />and wife (hereinafter the "Owners") located at 1700 Bohn's Point Road within the City of Orono <br />(hereinafter the "City") and legally described as follows: <br />Exhibit A, attached (hereinafter the "property"); and <br />WHEREAS, a condition of that variance approval was that any amendments to <br />the site plan which are not in conformity with City codes require further review; and <br />WHEREAS, on February 16, 2017 the Owners submitted a revised site plan and <br />building plans which depicted changes in the footprint shape, size and location of the proposed <br />residence structure, such changes being located lakeward of the defined average lakeshore setback <br />line and therefore triggering further review; and <br />WHEREAS, the City Council has reviewed the changes and finds that the site plan <br />revisions result in no additional impacts on neighboring properties' views of the lake and that the <br />findings of Resolution No. 6613 are still valid and applicable. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br />Minnesota hereby approves the revised site plan and hereby amends the conditions of Resolution <br />No. 6613 by substituting the revised site plan for the originally approved site plan. The revised <br />site plan is attached hereto as Exhibit B. All other conditions of Resolution No. 6613 shall remain <br />in effect as originally adopted. <br />Adopted by the Orono City Council on the 27th day of February, 2017. <br />ATTEST: <br />Anna Carlson, City Clerk <br />Dennis Walsh, Mayor <br />
