(6.42 acre) 658' <br />Section 78-1370 <br />Accessory structures shall adhere to all requirements of this chapter, with the following <br />additional requirements: <br />a. Accessory structures within a back lot shall be allowed no closer than ten feet to a <br />neighboring property's side or rear yard. <br />b. Accessory structures shall not be allowed within the required street yard of a back lot <br />nor within the required rear yard of a front lot which abuts the street yard of a back lot. <br />c. No accessory structure shall be allowed within an access outlot. <br />These requirements are met. <br />Applicable Regulations: Conditional Use Permit for Essential Services (Section 78-946) <br />A conditional use permit is required for all structures, including utility poles and rights-of-way, <br />which are an integral part of a system for public transportation as for transmitting power, <br />water, heat, communications, gas or sewage by any public utility. The council shall grant a <br />conditional use permit only after a showing that the public safety, health and welfare will not <br />be harmed by the essential services. Personal wireless services and commercial broadcasting <br />antennas and towers shall not be considered essential services. <br />Analysis: The most impactful aspect of the improvement is the visible 30 foot tall tower. <br />The 30 feet height is the maximum permissible height for principal structures in the zoning <br />district. <br />The tower is to be located in the NE corner of the property. Immediate neighbors are the <br />fire station to the East, and the Dakota Rail trail to the north. The nearest residential is <br />approximately 220 feet to the north, in Spring Park, and across the trail and Northern <br />Avenue. The tower in this area will be visible, as existing vegetation along the rail right of <br />way will not completely screen the tower. <br />
