This will enable us <br />to maintain proper drainage from our home without impacting our neighbor's property. <br />The detached garage is an existing structure on the property not constructed by the applicants. The <br />footprint of the existing garage will be used for the new garage, however, in order to comply with City <br />requirements the floor elevation will need to be raised by .5 ft. This requirement, as well as an increase <br />in the height of the garage to accommodate a 8 foot door will increase the structure height within the <br />non -conforming 30 ft rear setback and the 75 ft channel setback. (See garage top and side view drawing <br />and overlay.) The garage will still sit well below the road, tucked in the corner with fence and vegetation <br />screening from the channel, road, and not visible from the neighbor's home. <br />3. "The variance, if granted, will not alter the essential character of the locality." <br />The essential character of the property will not be altered by either the garage height or the site <br />elevation variance. <br />4. "Economic considerations alone do not constitute practical difficulties if reasonable use for the <br />property exists under the terms of the Zoning Chapter." <br />5. "Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar <br />energy systems. Variances shall be granted for earth sheltered construction as defined in Minnesota <br />Statutes, Section 1161.06, Subd. 2, when in harmony with this Chapter." <br />6. "The Board of Appeals and Adjustments or the Council may not permit as a variance any use that is <br />not allowed under this Chapter for property in the zone where the affected person's land is located." <br />This form is a required submittal for ALL variance applications. An application will not be considered <br />complete or placed on any meeting agendas until this form is complete and submitted to the City. <br />Variance Application — May 2016 <br />7. 'The Board or Council may permit as a variance the temporary use of a one -family dwelling as a two- <br />family dwelling." <br />8. `The special conditions applying to the structure or land in question are peculiar to such property or <br />immediately adjoining property." <br />9. "The conditions do not apply generally to other land or structures in the district in which said land is <br />located." <br />10. `The granting of the application is necessary for the preservation and enjoyment of a substantial <br />property right of the applicant." <br />Granting of the variances will lessen the intrusion into the east side set back and hard cover total. The <br />variance on the northwest corner will allow for proper drainage and have no impact on the neighbor's <br />property.
