City of Orono <br />Variance Application and Request for exception to consider at public hearing <br />2800 Shadywood Roars <br />Why requesting exception to consider at public hearing: <br />We have been working with the City of Orono since July, 2016 to ensure compliance with City <br />regulations in the teardown and construction of a new home at 2800 Shadywood Rd. This property is <br />unique in that there are setback requirements for Lake Minnetonka on the north as well as the Barrows <br />Channel on the east. It was our goal to move the new home farther away from the channel than the <br />existing home (not built by the applicants). By doing this we were able to reduce the structure footprint <br />and volume within the 75 ft setback from the channel, as well as the hardcover within this area. The <br />building plan was developed with these changes and the home was moved nearer the west lot line <br />following the 10 foot setback regulation. <br />Through working with the Minnehaha Watershed District, it was determined that a portion of the new <br />home was in the 931.5 flood plain. The Minnehaha Watershed District has approved our request for the <br />construction of the home with floodplain alteration -15 cubic yards of fill volume will be added under <br />the home and a compensating incremental floodplain cut will be made near the channel. See survey <br />showing updated floodplain contour (931.5) and proposed cut/fill map. <br />At a meeting with the City of Orono on November 15 it was discovered that an extension of the 931.5 <br />elevation is required for 15 feet from the house. Given the 10 foot setback on the west side of the <br />house, 15 ft extends into the neighbor's lot. We are asking for a variance from the 931.5 elevation for a <br />very small portion of the northwest corner of our building pad. This will enable us to maintain proper <br />drainage from our home without impacting our neighbor's property. The Orono City staff asked us to <br />approach the Council with this variance request in this manner. <br />It was also suggested that the other variance that we are requesting for replacing the existing garage be <br />included at the same time to keep the building packet intact. <br />There is an existing detached garage on the property that we are requesting to tear down and rebuild in <br />the existing footprint. We are requesting two setback variances. The first is a rear setback variance. <br />Currently the existing structure is 25 ft from the rear property line where 30 ft is required. The second <br />variance is for the setback from the channel. The existing structure is 40.9 ft from the channel where 75 <br />ft is required. We are asking to rebuild on the same footprint but increase floor elevation (from 932.0 to <br />932.5) per City of Orono guidelines and increase the height of the garage to accommodate an 8 foot <br />garage door. The garage will still sit well below the <br />road, tucked in the corner with fence and vegetation screening from the channel and road, and not <br />visible from the neighbor's home. <br />RECEIVED <br />NOV ,X20,6 # 3885 <br />
