No variance shall be granted or changed beyond the use <br />permitted in this chapter in the district where such land is located. <br />Practical Difficulties Statement <br />Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Practical Difficulties Analysis <br />Staff finds there is practical difficulties in the property. The property was given multiple variances <br />in 2012 to construct a new home. The lot is substandard in area and width. The applicant is <br />proposing minimal new hardcover with the proposed deck stairs and the proposed deck will align <br />with the existing deck and be constructed over an existing patio creating no new sightline <br />encroachments for the northern property. It appears that the hardcover variance is in part <br />supported by the longer than typical driveway to accommodate the long, narrow lot. <br />Public Comments <br />To date, no public comments have been received. <br />Issues for Consideration <br />Does the Planning Commission find that that the property owner proposes to use the <br />property in a reasonable manner which is not permitted by an official control? <br />Does the Planning Commission find that the variance(s), if granted, will not alter the <br />essential character of the neighborhood? <br />Planning Staff Recommendation <br />Planning Staff find the proposed variance reasonable. Planning Commission should review the <br />proposed variance and make a motion to recommend approval if the provided findings meet all <br />of the variance standards.
