Rivers of Windward Mariner Inc., <br />(hereinafter "the applicant") is the owner of the property <br />located at 1444 Shoreline Drive within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Exhibit A, attached (hereinafter "the property"); and <br />. WHEREAS, on October 5, 1988, the City approved a <br />commeraial.site plan and multiple zoning variances for the major <br />upgrading �pf the commerial marina involving improvement on both <br />the Tanager Lake and Brown's Bay sides of the lake. The <br />applicant has completed the proposed .improvements on the Brown's <br />Bay side and has filed a revised commercial site plan and a <br />variance application seeking multiple variances for the <br />relocation and construction of the commercial building on the <br />Tanager Lake side that would require the following variances: <br />A) Section 10.41, Subdivision S - Required parking stalls. <br />Required = 77 stalls <br />Existing = 76 stalls <br />Proposed = 73 stalls <br />Variance = 4 stalls or .05% <br />(Parking area separated by public roadway - Tanager Lake <br />side = 47 stalls; Brown's Bay side = 26) <br />B) Section 10.41, Subdivision 7 (A) 3 —Variances sought to the <br />required 10' landscaping buffer adjacent to roadway. <br />Required 50'., -:.(maximum allowed break in landscaping <br />°rfor access purposes) <br />Proposed = 60' <br />Variance = 10' or 20% <br />Page 1 of 7 <br />
