CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION <br />AMENDING RESOLUTION NUMBERS 4202 and 4369 <br />REGARDING THE PLAT OF PHILLIPS WOODLAND TERRACE 3RD ADDITION <br />FILE NO. #LA18-000012 <br />WHEREAS, on February 13, 2018, Mark Stipakov (the "Applicant"), applied for an <br />amendment of the conditions relating to the private road in Resolution No. 4202 and Resolution No. <br />4369 regarding Phillips Woodland Terrace 3rd Addition for the following properties: <br />2150 Sixth Avenue North; legally described as: Lot 2, Block 1, Phillips Woodland <br />Terrace 31 Addition, Hennepin County, Minnesota (hereinafter the "Stipakov <br />Property"); and <br />• Outlot A, Phillips Woodland Terrace 3rd Addition, Hennepin County, Minnesota <br />(hereinafter the "Outlot"); <br />WHEREAS, the Applicant has made a request to amend the conditions with <br />Resolution No. 4202 and 4369 requiring an upgrade of the existing private driveway, within the <br />Outlot, to City road standards at the time of development of the Stipakov Property; and <br />WHEREAS, the Applicant has requested the City accept a hammerhead <br />alternative to the required cul-de-sac turnaround to be located partially within the Outlot and also <br />within a new easement created over the Stipakov Property; and <br />WHEREAS, on April 16, 2018, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br />WHEREAS, on April 16, 2018, the Planning Commission recommended approval <br />of the amendment; and <br />WHEREAS, on May 14, 2018 the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested amendments to Resolution No. 4202 and 4369 as described <br />above based on one or more of the following findings of fact concerning the Property: <br />
