Agreement No. XXXXX <br />City Project No. 18-021 <br />State Aid Project No. 152-102-017 <br />Old Crystal Bay Road (MSAS102) <br />City of Orono <br />Orono Public School District <br />DR AFT <br />CONSTRUCTION COOPERATIVE AGREEMENT <br />THIS AGREEMENT, made and entered into this day of <br />, 20 by and between the City of Orono, a body politic and corporate <br />under the laws of the State of Minnesota, hereinafter referred to as the "City", and the Orono Public <br />School District, a body politic and corporate under the laws of the State of Minnesota, hereinafter <br />referred to as the "School". <br />WITNESSETH: <br />WHEREAS, the City is preparing to improve Municipal State Aid Street No. (MSAS) 102 <br />(Old Crystal Bay Road) from County State Aid Highway No. (CSAH) 6 to CSAH 112 in the City of <br />Orono (City Project No. 18-021), as shown on the plan set marked exhibit "A"; and <br />WHEREAS, the project includes construction of new accesses, removal of select access and <br />alteration of school parking & traffic circulation facilities. <br />WHEREAS, both the road improvements and school improvements are intended to work in <br />concert to address congestion and safety issues associated with School drop-off and pickup traffic <br />throughout the corridor; and <br />WHEREAS, the City and the School have been negotiating to bring about the improvement of <br />Old Crystal Bay Road as shown on the City Engineer's plans for City Project No. 18-021 which <br />improvements contemplate and include grading, aggregate base, bituminous surfacing, drainage, <br />watermain, sanitary sewer, curb and gutter, concrete walk, bituminous trail, parking lot, lighting, <br />landscaping and other related improvements, and which shall hereinafter be referred to as the <br />"Project"; and <br />WHEREAS, the above described Project lies within the corporate limits of the City with <br />portions on School Grounds; and <br />WHEREAS, the City Engineer has heretofore prepared an Engineer's Estimate of quantities <br />and unit prices for the above described Project in the sum of $3,221,725.50.
