MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, February 26, 2018 <br />7:00 o'clock p.m. <br />PLANNING DEPARTMENT REPORT <br />11. #18-3998 JAMES AND MARY JUNDT, 1400 BRACKETTS POINT ROAD, <br />PRELIMINARY PLAT, STREET VACATION — RESOLUTION NOS. 6835 & 6836 <br />Barnhart reviewed his Staff report regarding a request for preliminary plat approval and right-of- <br />way/easement vacation associated with a proposed 5 -lot subdivision located at 1400 Bracketts Point <br />Road. All lots meet the requirements of the zoning ordinance in terms of lot width and size and the plan <br />is consistent with the Comprehensive Plan. <br />The main feature of the project is the relocation of a portion of public Bracketts Point Road from the <br />western edge of the peninsula to the center of the peninsula. This relocation will require vacation of the <br />existing right-of-way and the sanitary sewer easement along this road. The proposed configuration and <br />cul-de-sac improve the circulation in the area, allows for a more efficient turnaround, removes hardcover <br />away from the lake, and creates a more logical route for access to the three lots to the south of the point. <br />The Planning Commission voted 5-0 on two separate motions; one, to approve the right-of-way and the <br />easement vacation; and two, to approve the preliminary plat as recommended in the staff report. During <br />the public hearing a neighboring property owner commented that the private portion of Bracketts Point <br />Road should be converted to a public road. Since that meeting that property owner has contacted city hall <br />with a petition to convert the road from private to public. The road is currently proposed simply as a <br />relocation of an existing public road and is proposed to remain public. Staff will investigate the condition <br />of that road and report back to the City Council in the future. <br />Staff recommends approval of the preliminary plat and vacation of the road and easements subject to the <br />conditions outlined in the staff report. Barnhart noted the DNR supports the vacation as well. <br />Chuck Algon, Developer, stated they accept the staff report as presented and there are no additions or <br />corrections. <br />Dankey asked if the City would perform the work to relocate the sewer line. <br />Barnhart indicated the developer will complete the work to City specifications at their expense and the <br />City will approve the work after completion. <br />Walsh commented the application is pretty straight forward. <br />Printup moved, Crosby seconded, to adopt RESOLUTION NO. 6835, a Resolution Approving <br />Preliminary Plat for Southways, and to adopt RESOLUTION NO. 6836, a Resolution Vacating a <br />Portion of Brackett's Point Road and Sanitary Sewer Easement, subject to Staff recommendations. <br />VOTE: Ayes 4, Nays 0. <br />12. #17-3984 CITY OF ORONO, TEXT AMENDMENT, SHORT-TERM (VACATION) <br />RENTALS — ORDINANCE NO. 204, THIRD SERIES <br />Barnhart noted at the February 12 meeting, the City Council directed Staff to draft an ordinance that <br />requires a license of all residential rental property and a prohibition of any rental term less than 30 days, <br />except for a homesteaded property owner may rent up to two rooms of their home while occupied by the <br />Page 4 of 13 <br />
