Insituform Technologies USA, LLC <br />17988 Edison Avenue <br />Chesterfield, MO 63005 <br />FINAL LIEN WAIVER <br />Reference that certain Agreement between Insituform Technologies USA, LLC as Contractor and <br />City of Orono Minnesota as Owner, on Project known as: 2017 Sanitary Sewer Improvements, <br />for work to be performed by said Contractor. Reference also that certain Invoice No(s) of <br />Contractor to said Owner in the amount of $207,134.50 work, labor and materials installed in or <br />furnished for said Project by and through Insituform Technologies USA, LLC, of which Owner <br />has made payment in the amount of $207,134.50, leaving an unpaid balance in the amount of <br />$0.00. <br />Contractor acknowledges receipt of Owners remittance for the amount of $207,134.50 as final <br />payment and contingent upon the final clearance and payment of said remittance, and further <br />Contractor agrees to and does hereby waive and release said Property, Project, Owner and Owner <br />from any and all liens, statutory or otherwise, for any and all work, labor and materials furnished <br />by or through Insituform Technologies on said project to and including the work, labor and <br />materials to the extent of payment in the amount of $207,134.50. . <br />The remittance of Owner identified as payment of $207,134.50 marked "paid" or otherwise <br />canceled by the bank against which said remittance was drawn shall constitute conclusive proof <br />that amount was paid and that said payment thereof was received by Contractor and this Lien <br />Waiver shall become effective automatically and without requirement of any further act, <br />acknowledgement or receipt on the part of the Contractor named herein. <br />Dated this 6th day of February, 2018 <br />Insituform Technologies USA, LLC <br />By: 7 <br />Title: Senior Controller <br />Subscribed and sworn to before me, the undersigned Notary Public within and for the State of <br />Missouri, and the County of Saint Charles, this 6th day of February, 2018 in the City of Saint <br />Charles. <br />Notary Public within and for said County and State: <br />My commission expires: March 19, 2019 <br />EN <br />.
