Rights-of-way are needed for future roadways in the opinion of the city. <br />C. Right-of-way widths or additional widths in existing rights-of-way in excess of the <br />standards designated in this chapter when, due to topography, additional width is necessary to <br />provide adequate earth slopes. Such slopes shall not be in excess of 3:1. <br />Both Northern and Togo are local roads, suggesting the need for 50 feet of right-of-way (25 feet <br />on each side of Togo, 50 feet north of the rail line for Northern). However, dedication of 50 feet <br />of right-of-way would make the southern two lots (Lots 2 and 3) unbuildable. The Northern Oaks <br />addition to the west along Northern Avenue was required to dedicate additional right-of-way, to <br />get to 30 feet. The developer has shown a 15 -foot right-of-way dedication beyond the existing <br />Northern Avenue consistent with the Staff recommendation during the sketch plan review. <br />City Engineer Comments <br />The consulting City Engineer has reviewed the preliminary plat application materials; comments <br />are attached as Exhibit I. The developer should prepare a final plat application which responds <br />to and incorporates these recommendations. <br />Drainage & Utility Easements <br />The City requires standard perimeter drainage and utility easements around all property <br />boundaries in the Plat and drainage easements over the wetland areas. The easements as <br />shown on the proposed plat drawing must be revised to meet the City standards. <br />Park Dedication <br />The Parks, Open Space and Trail Plan element of the Orono Comprehensive Plan does not <br />specify the need for a neighborhood park at this location. The site is near the Navarre Park, and <br />is directly adjacent to the Dakota Trail. As there is no defined need for park land at this location, <br />it would appear that dedication of actual land for park purposes is not required. Absent the <br />need for park land dedication, a Park Dedication Fee in lieu of land would be appropriate per <br />City Ordinance. <br />The Park Fee is determined as 8% of the fair market value of the land being subdivided, but <br />must be between a minimum of $3,250 and a maximum of $5,550 per residential dwelling unit. <br />For the proposed lots, the Park Fee would be based on only the 2 new lots. The City's Assessor <br />will be consulted to determine the market value of the land for establishing the amount of the <br />fee. <br />
