Minutes of the <br />Orono City Council Work Session <br />Monday, January 22, 2018 <br />Council Chambers 6:00 p.m. <br />PRESENT: Mayor Dennis Walsh, Council Members Aaron Printup, Richard F. Crosby II, <br />Victoria Seals and Wendy Dankey. Representing staff were Development Director Jeremy <br />Barnhart, Police Chief Correy Farniok, Prosecuting Attorney Steve Tallen, and City Clerk <br />Anna Carlson. <br />Meeting Start Time: 6:00 p.m. <br />1. Short Term Rental Regulation <br />Community Development Director Jeremy Barnhart began the discussion by reviewing the <br />potential drafts of the ordinances that would prohibit rental of residential property for periods less <br />than 30 days. <br />Staff had developed two options for the council to review, Option A addresses requirements of <br />the City Council discussed in November. Option B is the same as Option A, except the licensing <br />requirement has been removed. <br />Of the two options, Barnhart mentioned that staff would advocate for Option B. He added that the <br />main issues are still there in terms of the enforcement but would like to address those issues <br />further through discussion. <br />Prosecuting Attorney Steve Tallen addressed some of his concerns regarding the proposed short <br />term rental licensing ordinances. Tallen added that his main concern is that by making violation <br />of the ordinance a criminal offense under City Code, as opposed to an administrative violation, <br />that the City would be creating enforcement issues that would be very difficult to overcome. <br />Police Chief Correy Farniok discussed the process of enforcing violations. Farniok mentioned <br />that it is not easy to enforce noise violations due to the difficulty of monitoring the duration and <br />timing of the noise. <br />The group discussed the options and their views for regulating short term rental licensing. The <br />group also collectively discussed the various options the city could do to control the issue. <br />Barnhart noted it might be appropriate to revisit the nuisance regulations. <br />Mayor Dennis Walsh directed staff to bring the two options forward at the next City Council <br />meeting so the council could revisit the options and make a decision. <br />Meeting End Time: 6:47 p.m. <br />ATTEST: <br />Anna Carlson, City Clerk Dennis Walsh, Mayor <br />
