AGENDA ITEM <br />Item No. 10 <br />Date: January 8, 2018 <br />Item Description: #17-3979, Steven & Kimberly Schottler, 2740 Shadywood <br />Road, ATF Variance — Resolution <br />Presenter: Melanie Curtis Agenda Consent Agenda <br />Planner Section: <br />1. Purpose. This application is regarding an after -the -fact variance to permit a covered <br />screen porch addition on the lake side of the home constructed within the 75 -foot setback, <br />and within the average lakeshore setback without a permit. <br />2. MN§15.99 Application Deadline. The application was received on September 20, <br />2017; it was considered as complete on October 11th. The original 60 day review period <br />expired December 10, 2017. Prior to that, staff extended the review deadline to February <br />8, 2018. <br />3. Background. In September of 2016, a stop work notice was issued for unpermitted <br />construction of a new screen porch on the lake side of the home. After a follow up <br />inspection and letter to the owners in July of 2017 regarding the unpermitted porch, the <br />owners met with staff to discuss the process for applying for after -the -fact variances. The <br />variance application was made complete on October 11th. <br />Previously a smaller, 26 foot wide 2nd story deck extended 11 feet from the house toward <br />the lake. An 11.6' x 11.6' deck was built where the previous existing deck was located. <br />Next to the new deck, the new 25.6' x 31.5' roofed screen porch now extends 31.5 feet <br />toward the lake; 20 feet lakeward of the average Lakeshore setback line and <br />approximately 2 feet into the 75 -foot setback. <br />4. Planning Commission Comment. On November 20th, the Planning Commission held a <br />public hearing and reviewed the application. Following the public hearing the Commission <br />voted 4 to 1 on a motion to approve the after -the -fact variances subject to issuance of a <br />building permit conditioned on compliance with Building and Fire Codes. <br />5. Public Comment. Comments were received and submitted as exhibits to the Planning <br />Commission. No additional comments from the public were received regarding this <br />application. <br />6.
