Agreement No. PW 56-32-17 <br />CSAH 112; C. P. 091102 <br />must be developed in accordance with the attached "Hennepin County Department of Public Works — <br />Transportation Department; Recommended Urban Landscape/Streetscape Guidelines" and in <br />accordance with Hennepin County's Sustainable Landscape Guidelines for Successful Plantings. In <br />addition, the plans and specifications for the Landscaping Project must be approved by the County <br />and by the Minnesota Department of Transportation Division of State Aid for Local Transportation. <br />The City of Orono will advertise for bids for the work and construction of the Landscape <br />Project, receive and open bids pursuant to said advertisement and will enter into a contract with the <br />successful bidder at the unit prices specified in the bid of such bidder, according to law. The City of <br />Orono or its agents shall administer the contract and shall perform the required engineering, <br />inspection and testing for the Landscape Project. The County Highway Engineer and staff shall have <br />the right, as work progresses, to make any inspections deemed necessary, but will have no <br />responsibility for supervision of the work. <br />It is understood that all work to be performed under the Landscape Project shall be done either <br />in conjunction with or upon completion of the construction activities of the Project. It is further <br />understood and agreed that it shall be the responsibility of the City or its contractor to coordinate <br />construction of the Landscape Project with the County's construction contractor for the Project. <br />The County will participate in the costs of the Landscaping Project. The County's participation <br />in the costs of the Landscaping Project shall be one percent (1%) of the Project's contract <br />construction costs as shown in Exhibit "A", which is based on impact to trees within the CSAH 112 <br />roadway corridor. Accordingly, the County's share of the costs for the Landscaping Project shall be <br />Seventy One Thousand Five Hundred Forty Three Dollars and No Cents ($71,543.00 or 1% of <br />$7,154,267.30). It is understood by the parties that the County's cost contribution to the Landscaping <br />Project includes $20,000.00 for landscaping in the vicinity of the shared driveway at Old Long Lake <br />Road. <br />The County's share in the Landscape Project costs will be directly paid to the City of Orono <br />from the County and will not be addressed as credits applied to the City of Orono's proportionate <br />share of the costs for the Project. Upon completion of the Landscape Project by the City of Orono <br />and acceptance of work by the County Highway Engineer or a designated representative, the City of <br />Orono shall invoice the County for one hundred (100) percent of the County's share of the costs for <br />the Landscape Project. Within forty five (45) days after receipt of said invoice, the County shall <br />deposit with the City of Orono, said County share. <br />X <br />The County has retained consultant(s) to perform required archaeological studies for the <br />Project. At the request of the City of Orono, the County instructed its consultant to perform <br />archaeological work outside the construction limits of the Project. As shown in Exhibit "A", it is <br />understood and agreed that the City of Orono shall reimburse the County $685.00 for said city <br />requested archaeological work. <br />M <br />
