AGENDA ITEM <br />Item No.: 12 <br />Date: July 23, 2018 <br />Item Description: LAI 8-000040, Matthew & Angela Hopping, 95 Smith Avenue, <br />Conditional Use Permit — Resolution <br />Presenter: Melanie Curtis, Agenda Consent Agenda <br />Planner Section: <br />1. Purpose. Approval of a resolution for a CUP for grading. <br />2. MN§15.99 Application Deadline. The application was received and considered to be complete <br />on April 17' and would have expired on June 16t'. Due to the plan revisions, the application <br />review timeline was extended; therefore the 60 -Day review period now expires on August 15, <br />2018. <br />Background/ Summary. The applicants are planning to construct a new residence on the <br />property. The Council reviewed their plans in June; their grading CUP was approved, yet their <br />request for a second driveway curb cut was denied. As a result, the applicants have revised the <br />house layout and grading plan. Their revised grading plan now involves the import of <br />approximately 45 cubic yards of soil with a total site disturbance of approximately 702 cubic <br />yards. Grading and filling activities in excess of 500 cubic yards require a CUP. <br />4. Planning Commission Vote and Comment. On May 21St, the Planning Commission held a <br />public hearing and voted 7 to 0 on a motion to approve the requested CUP. <br />Public Comment. Comments from the neighbors were received during both meetings; no <br />written comments were received. <br />6. Staff Recommendation. The City Engineer and Planning staff have reviewed the revised plans <br />and found them to be acceptable. A resolution has been drafted which includes the following <br />Council requirements: <br />a. Parking during construction shall be limited to the odd side (the applicants' side) of the <br />street. The City shall provide signage for posting. <br />b. All contractors shall be put on notice by the applicants that no neighborhood residential <br />driveways are to be used for any purpose — turn around, backing up, parking, etc. <br />c. Staging, overnight parking, and vehicle maneuvering shall be done within the applicants' <br />property, to the extent feasible.
