C I T Y O F <br />LONG LAKE <br />City Council <br />Resolution No. 2018-08 <br />A RESOLUTION APPROVING A PRELIMINARY PLAT FOR LANDINGS AT LONG LAKE, <br />BLOCK 1, LOTS 1-4 AND VARIANCE TO ALLOW FOR FOUR SINGLE FAMILY <br />PROPERTIES TO BE SERVED BY A SHARED DRIVEWAY AND CURB CUT <br />WHEREAS, on September 13, 2017 the City of Long Lake deemed a Land Use Application <br />complete made by James Koch that included a request for a rezoning from R-2 Lakeshore Single <br />Family Residential District to PUD and a preliminary plat for Landings at Long Lake for property <br />legally described as: <br />The West 365 feet of the East 829 f -et of that part of Government 1-ot 4, Section 35, <br />Township 118, Range 23, which lies North of the U.S. Highway No. 12, formerly State Trunk <br />Highway No. 10; and extends from the said highway right-of-way to the shore of Long Lake <br />lying South of a line drawn East perpendicular to the West line of the East 829 feet of said <br />Government Lot 4 from a point thereon distant 39 feet South from the Northeast corner of <br />Tract A, Registered Land Survey No. 765. <br />WHEREAS, the existing property address is 1070 Wayzata Boulevard West with property <br />identification number 35-118-23-13-0018; and <br />WHEREAS, the applicant proposed to subdivide the property into five lots for future single- <br />family residential development but did not have plans for development at the time of application; <br />and <br />WHEREAS, the applicant proposed access to the five lots with a private street and City <br />ordinance permits private streets only through the approval of a PUD; and <br />WHEREAS, City Ordinance allows for the City Council to approve subdivisions, streets, <br />utilities and public facilities that are not in compliance with the City subdivision requirements for <br />pronPrty 7cned PUD if it finds tha trite . adher^rce to such requirements is not re-quired to meet the <br />intent of this Section or to protect the health, saiety or welfare of the residents of the PUD, the <br />surrounding area, or the City as a whole; and <br />WHEREAS, the applicant requested deviations from the following requirements of the City's <br />subdivision ordinance: <br />a. Side lot lines shall be at right angles to street lines, radial to curved street lines, or <br />radial to lake or stream shores unless the City determines that due to topographic <br />conditions, an alternative layout will result in a better street or lot plan. <br />b. Private streets are prohibited except as approved within a Planned Unit Development <br />and constructed according to City standards. <br />c. Cul-de-sac roads are permitted when designed to permit future road extensions into <br />adjoining properties or where topography, environmental, land use or existing <br />conditions justify their use as approved by the City Council. <br />d. The minimum right-of-way width for a local street is 60 feet. The applicant is <br />proposing 30 feet. <br />
