CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />In Re: <br />City of Orono Liquor STIPULATION OF FACTS <br />Licensing Complaint Against AND CIVIL SANCTION <br />Navarre Liquors <br />The City of Orono and its undersigned attorney, and Navarre Liquors through its <br />undersigned authorized officer, hereby agree and stipulate as follows: <br />Navarre Liquors is licensed under Orono City Code Section 34-66, to operate an <br />off -sale intoxicating liquor establishment at 3421 Shoreline Drive, Orono, Minnesota. <br />2. On September 5, 2018, Steven James Zerby, an employee, did sell intoxicating <br />liquor to an underage person in violation of State law and Orono City Code Section 34- <br />5(b)(1)(a). <br />This constitutes Navarre Liquors' first liquor license violation in the past 3 years <br />pursuant to Orono City Code Section 34-41. <br />4. Copies of the Orono Police Department reports regarding this incident are <br />incorporated into this Stipulation by reference. <br />5. Navarre Liquors shall pay a civil sanction in the amount of $500.00 by November <br />1, 2018. <br />6. Navarre Liquors waives its right to the hearing provided by Minnesota Statute <br />§ 340A.415 and Orono City Code Section 34-41. <br />7. The civil sanction set forth in Section 5 is contingent upon the Orono City <br />Council's approval. If the City Council rejects the sanction agreed to in this Stipulation in favor <br />
