AGENDA ITEM <br />Item No.: 16 <br />Date: December 10, 2018 <br />Item Description: Liquor Violation — Navarre Liquors <br />Presenter: Soren Mattick, Agenda Consent Agenda <br />City Attorney Section: <br />Purpose. The purpose of this item is to present a liquor violation to the City Council. <br />Background. The Orono Police Department conducts periodic compliance checks with all <br />establishments licensed to sell tobacco and liquor within the City of Orono. When an establishment sells <br />tobacco or liquor to a person that is not eligible to purchase these items, the City Code imposes a <br />presumptive penalty on the licensee. <br />On September 5, 2018 an employee of Navarre Liquors sold intoxicating liquor to an underage person in <br />violation of State law and Orono City Code Section 34-5 (a)(1)(a). The Stipulation of Facts and Civil <br />Sanction is attached to this Council Action item as Exhibit A. <br />The City will impose a civil sanction in the amount of $500. Per City Code Section 34-41 the <br />presumptive penalty for the 1St violation is $500. The Fee was paid by Navarre Liquors on November 30, <br />2018. <br />Staff Recommendation. Staff recommends the City Council Approve the Stipulation of Facts and Civil <br />Sanction Agreement. <br />COUNCIL ACTION REQUESTED <br />Consider a motion to approve the Stipulation of Facts and Civil Sanction Agreement. <br />Exhibits <br />A.
