A RESOLUTION VACATING <br />AN ACCESS EASEMENT AGREEMENT <br />WITHIN FRANZEL ADDITION <br />HENNEPIN COUNTY, MINNESOTA <br />- FILE NO. LA18-000080 <br />WHEREAS, the City of Orono is a municipal corporation organized and <br />existing under the laws of the State of Minnesota; and <br />WHEREAS, North Arm Farm, LLC (hereinafter the "Owner") is owner of <br />the property within the City of Orono, and legally described as follows: <br />Lots 1 and 2, Block 1 Franzel Addition, Hennepin County, Minnesota <br />(hereinafter the "Property"; and <br />WHEREAS, the property is subject to that certain Access Easement <br />Agreement in favor of the City of Orono dedicated and recorded with Hennepin County as <br />Document No. 4780829; and <br />WHEREAS, the aforesaid easement provides for an access route that does <br />not reflect an accessible route due to steep slopes; and <br />WHEREAS, the City has accepted a replacement easement that provides for <br />usable access to the liftstation, making the original easement obsolete, and; and <br />WHEREAS, after due published and mailed notice in accordance with <br />Minnesota Statutes and the Orono, Minnesota, City Code, the Orono City Council held a <br />public hearing on September 24, 2018regarding said vacation and all interested persons <br />were given an opportunity to be heard; and <br />WHEREAS, the Orono City Council finds the vacation as proposed is in <br />keeping with the public interest and in consideration of the following findings: <br />The portion of the Access Easement Agreement to be vacated would be a <br />Page 1 of 4 <br />
