Supplemental Environmental Project <br />52. Respondent must complete a supplemental environmental project (SEP) designed <br />to protect the environment and public health by installing sensors to minimize the volume and <br />duration of any future chlorine leaks at Respondent's Navarre and Highway 12 water treatment <br />plants. <br />53. Respondent must spend at least $24,845 to purchase and install a chlorine <br />detection system, which includes detectors installed in sufficient proximity to its chlorine storage <br />and piping to alert Respondent of an accidental release as soon as practicable and notify <br />responsible employees. This amount may also include installation, software, training and <br />operating costs for five years. Respondent will complete the project by January 31, 2019, <br />54. Respondent certifies as follows: <br />a. Respondent is not required to perform or develop the SEP described in <br />paragraph 52 by any law, regulation, order, or agreement (other than this <br />CAFO) or as injunctive relief as of the date that I am signing this CAFO. <br />b. Respondent has not received and will not receive credit for this SEP in any <br />other enforcement action. <br />c. Respondent is not a party to any open federal financial assistance transaction <br />that is funding or could be used to fund the same activity as the SEP. <br />d. To the best of my knowledge and belief after reasonable inquiry, there is no <br />such open federal financial transaction that is funding or could be used to fund <br />the same activity as the SEP, nor has the same activity been described in an <br />unsuccessful federal financial assistance transaction proposal submitted to U.S. <br />EPA within two years of the date that I am signing this CAFO (unless the <br />project was barred from funding as statutorily ineligible). For purposes of this <br />certification, the term "open federal financial assistance transaction" refers to a <br />grant, cooperative agreement, loan, federally -guaranteed loan guarantee, or <br />other mechanism for providing federal financial assistance whose performance <br />period has not expired. <br />e. All cost information provided to U.S. EPA in connection with U.S. EPA's <br />approval of the SEP is complete and accurate, and Respondent in good faith <br />estimates that the cost to implement the SEP is $24,845. <br />f. The SEP is not a project that Respondent was planning or intending to perform <br />or implement other than in settlement of the claims resolved in the CAFO. <br />g. Respondent will not receive reimbursement for any portion of the SEP from <br />another person or entity. <br />
