The applicant is asking to reconstruct a 2 foot tall retaining wall in a new location within <br />the drainage and utility easement. <br /> <br />2. Background/ Summary. Per City Code, 78-1405 (5.1) Retaining walls may be located in all <br />required yard when they are at least 10 feet from the edge of a roadway, the structure creates no impacts <br />to drainage direction, rate or volume for adjacent properties and it cannot exceed 2 feet in height. If the <br />structure is in a D/U easement an Encroachment Agreement approved by the City Council is granted, <br /> <br />The property currently has a retaining wall in the side yard setback and as part of the new home permit <br />are looking to move the location of the retaining wall to create a walkway/access from the street yard to <br />the lake yard. The proposed project meets all of the requirements for the proposed 2 foot retaining wall <br />and are requesting the council to approve the drafted encroachment agreement. <br /> <br /> <br />3. Public Comment. This is not a public hearing and no public comments were received. <br /> <br />4. Staff Recommendation.
