To consider a variance and resolution that would allow a 6 foot tall fence in the street <br />yard where a 42 inch high fence is permitted. <br /> <br />2. MN§15.99 Application Deadline. The application was received on October 17, 2018 and <br />considered to be complete on October 17th. The 60-Day review period has been extended and will <br />expire on February 16, 2019. <br /> <br />3. Background The applicant is requesting a variance to install a 6 foot tall fence in the street yard <br />adjacent to Ferndale. 42 inch high fences are permitted here. If Ferndale was a county or state <br />road, the fence could be up to 6 feet high. <br /> <br />4. Planning Commission Vote and Comment. On January 22, 2019, the Planning Commission <br />held a public hearing. Following the public hearing, the Planning Commission voted 5-0 on a <br />motion to approve the requested variance. <br /> <br />The members of the Commission were in agreement that the additional height of the fence, the <br />configuration of the lot (it is bisected by Ferndale), the use of Ferndale, and the design of the <br />fence support the variance while preserving the neighborhood character. <br /> <br />5. Public Comment. No comments have been received for or against the application <br /> <br />6. Staff Recommendation. Staff recommends the Council adopt the resolution. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the approval resolution and adopt or amend. <br /> <br />Exhibits <br />A.
