<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. ________________________ <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING A PRELIMINARY PLAT <br />OF THE PROPERTY AT: <br />387 ORONO ORCHARD ROAD SOUTH <br /> <br />FILE NO. LA18 -000062 <br /> <br /> WHEREAS on December 26, 2018, Sven Gustafson (hereinafter the “Developer”), <br />is the owner of the property within the City of Orono (hereinafter the “City”) addressed 387 Orono <br />Orchard Road South; and <br /> <br /> WHEREAS, the Developer made application for Preliminary Plat approval to create <br />two buildable lots from the property legally described as: <br /> <br />Lots 1 and 2, Block 1, SMITH-DETTLOFF ADDITION, EXCEPT that part lies <br />northerly of a line described as follows; Commencing at the southeast corner of said <br />Lot 1; thence North 0 degrees 05 minutes 55 seconds West along the east line of Lot <br />2 a distance of 410.99 feet to the northeast corner of Lot 2, the point of beginning; <br />thence North 84 degrees 25 minutes 53 seconds West a distance of 261.89 feet; <br />thence North 50 degrees 30 minutes 10 seconds West a distance of 589.61 feet; <br />thence North 0 degrees 07 minutes 06 seconds West a distance of 115.50 feet to the <br />north line of Lot 2 and there terminating, Hennepin County, Minnesota, (hereinafter <br />the “Property”); <br /> <br /> WHEREAS, on January 22, 2019, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br /> <br /> WHEREAS, on January 22, 2019, the Planning Commission recommended <br />approval of the preliminary plat; and <br /> <br /> WHEREAS, on February 11, 2019, the City Council reviewed the application and <br />the recommendations of the Planning Commission and City staff; <br /> <br /> WHEREAS, the City Council reviewed the proposal at a regular meeting held on <br />February 11, 2019, and hereby made the following findings with regards to this application: <br /> <br />
