To adopt the resolution and findings based on Council’s December 10th action. <br /> <br />2. MN§15.99 Application Deadline. The application was received on October 17, 2018 and <br />considered to be complete on October 30th. The 60-Day review period has been extended and will <br />expire on February 27, 2019. <br /> <br />3. Background/ Council Vote. The City Council reviewed variance for this property on December <br />10th and voted 2-1-1 to approve an average lakeshore setback consistent with a modified “corner <br />to corner” setback line based on the closed corners of the Dunkley and Hueler homes to the <br />subject property, shown as a dashed line in Exhibit B. Mayor Walsh and Councilmember Dankey <br />voted aye; Councilmember Seals voted nay; and Councilmember Crosby abstained. <br /> <br />4. Planning Commission Vote and Comment. On November 19th, the Planning Commission held <br />a public hearing. Following the public hearing, the Planning Commission voted 4 to 2 on a <br />motion to deny the requested variance. <br /> <br />The members of the Commission were in agreement that, due to the lack of demonstrated <br />practical difficulty, denial of the variance as requested would be an appropriate; however the two <br />dissenting Commissioners indicated that they may be supportive of the portion of the proposed <br />home within the area identified by the closest point to point measurement as shown in Exhibit B. <br /> <br />5. Public Comment. Comments from the neighbors were received and were included in the <br />Planning Commission packet. <br /> <br />6. Staff Recommendation. Staff recommends the Council adopt the resolution. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the approval resolution and adopt or amend. <br /> <br />Exhibits <br />A.
