This application is regarding a request for a number of variances in order to <br />build a new home on the property. <br /> <br />2. MN§15.99 Application Deadline. The application was received on January 23, and <br />considered to be complete on February 8th. Therefore the 60-Day review period expires <br />on April 9, 2019. <br /> <br />3. Background/ Summary. The subject property is nonconforming with respect to area <br />and width, the 75-foot and average lakeshore setback from the lake bisect the lot. <br /> <br />Variances for lot area, lot width, height, hardcover, driveway width in the 75-foot setback <br />are requested in addition to a 75-foot setback, and rear yard setback variances for the <br />house and deck. The height variance is in response to a desire to correct ‘unnatural’ <br />grades at the rear of the lot. In the past, to support a different house and detached garage, <br />the rear yard was graded to create a low flat area, requiring retaining walls. The applicant <br />is proposing to restore the grades to better flow into the neighboring lots. Since a <br />buildings’ height limitation is based on the “existing grade”, and this grade correction has <br />not occurred, a height variance is necessary. <br /> <br />4. Planning Commission Vote and Comment. On February 19th the Planning Commission <br />held a public hearing. Following the public hearing the Planning Commission voted 5 to <br />0 in favor of a motion to approve the requested variances. <br /> <br />5. Public Comment. No comments from the public were received. <br /> <br />6. Staff Recommendation.
