<br /> The Park District will pay for the initial costs associated with design, construction <br />administration, and construction. The City and the County will reimburse the Park District for <br />their share of the costs upon substantial completion. If the project is cancelled, then one-third <br />(1/3) of the costs incurred to date shall be provided by each Party upon project termination. <br /> <br />All Parties understood and agreed that if it is determined that a temporary construction <br />easement along CR 19 is needed to construct the project, the County shall acquire the temporary <br />construction easement without incurring additional cost to the County’s cost participation of <br />$100,000.00. The costs for the temporary construction easement and permanent easement or <br />right of way land acquisition are included in the total estimated costs of the project of <br />$300,000.00. <br /> <br />The Park District will obtain approval of the plans and specifications from the County <br />and the City. The plans and specifications shall conform to Minnesota Department of <br />Transportation (MnDOT) Design Standards applicable to County State Aid Highways and to the <br />requirements of the Americans with Disabilities Act (ADA). Design and construction of the <br />Navarre Connector will, to the extent possible, conform to design standards and guidelines <br />adopted by the Park District. It is further understood and agreed that the County shall have final <br />discretion over the design of the multi-use trail including safe crossing design, and interpretation <br />and execution of engineering best practices. <br />The party who is responsible for trail design, construction and/or reconstruction shall <br />provide all trail regulatory signs as prescribed by the Minnesota Manual on Uniform Traffic <br />Control Devices (Mn MUTCD), as a part of the design and construction of the Trail. <br /> <br />As referenced, the County will acquire all additional right of way, permits and/or <br />easements required for the future reconstruction of the CR19 roadway corridor. It is further <br />understood and agreed that any and all Park District permits that may be required shall be <br />granted at no cost or expense to the County or its contractors. <br /> <br /> <br />V <br />Ownership, Operations and Maintenance <br /> <br />It is understood and agreed by the Parties hereto that the Navarre Connector shall become <br />the property of the City and all routine and preventative maintenance, restoration, repair, <br />replacement or other work or services required thereafter shall be performed by the City to <br />prolong the useful life of the trail at no expense to the County or the Park District except as <br />provided below. The City and its agents and licensees shall have the sole and exclusive right and <br />authority to operate and control the Navarre Connector and to establish rules and regulations <br />governing its use to the extent not in conflict with ordinances of the County or the Park District. <br /> <br />It is further understood and agreed that the County and Park District will waive all <br />required permits for the City to perform any maintenance, restoration, repair or replacement of <br />the Navarre Connector. <br /> <br />It is understood that in the future a portion of the Navarre Connector may be included as
