The existing 441 square foot garage is 2.5 feet from the side lot line. The applicant is <br />proposing a 4.3 foot setback for a new 744 square foot two-story garage. A conditional use permit <br />(CUP) is requested so that a full bathroom with shower/bathtub can be installed. For lots that are non-conforming as to their width, the interior <br />side yard setback for the principal building, and accessory buildings less than 1,000 square feet, <br />shall be the lessor of ten feet or equal to ten percent of the lot width as defined. However, in no <br />case shall the side yard setback be less than 7.5 feet. <br />Application Summary: The applicant is requesting to reconstruct an existing nonconforming <br />detached garage with a larger footprint at a 4.3 foot setback where a 2.5 foot setback exists, <br />and a 7.5 foot* setback is required.
