This application is regarding a setback variance and CUP for plumbing for a new <br />detached garage. <br /> <br />2. MN§15.99 Application Deadline. The application was received and considered to be complete <br />on February 20, 2019. Therefore the 60-Day review period expires on April 2019. <br /> <br />3. Background/ Summary. The applicant is requesting a side setback variance to permit the <br />reconstruction of an existing one-level, detached garage in a larger footprint at an improved but <br />still substandard side yard setback. The existing 441 square foot garage is currently 2.5 feet from <br />the side lot line. The applicant is proposing a 4.3 foot setback for a new 744 square foot two-story <br />garage. A conditional use permit (CUP) is requested so that a full bathroom with shower/bathtub <br />can be installed. <br /> <br />4. Planning Commission Vote and Comment. On March 18, the Planning Commission held a <br />public hearing. Following the public hearing the Planning Commission voted 6 to 0 on a motion <br />to approve the request. <br /> <br />5. Public Comment. Comments from a neighbor was received and is attached as Exhibit D. <br /> <br />6. Staff Recommendation. The owners have agreed to the covenant limiting the use of the <br />detached garage relating to the plumbing CUP. Staff recommends approval. <br /> <br />COUNCIL ACTION REQUESTED <br />The Council should consider a motion to adopt or amend the approval resolution. <br /> <br />Exhibits <br />A.
