This application is regarding a one-year Council-approved extension of Resolution No. <br />6833 granting variances and CUPs. <br /> <br />2. City Code. City Code Sections 78-129 and 78-918 provide for extension of variance and CUP <br />approvals. Staff may administratively approve a one-year extension of the approval from the original <br />City Council approval date; City Council approval is required for additional one-year extensions, up <br />to three total extensions. <br /> <br />3. Background/ Summary. The applicant is requesting renewal of variances and conditional use <br />permits originally granted to William Toles (the previous owner) via Resolution No. 6759 on May 8, <br />2017. The approvals involved a conditional use permit to rearrange the floodplain on the property and <br />variances for lot area and width; lakeshore setback; average lakeshore setback; floodplain setback; <br />and 0-75’ hardcover. A conditional use permit to permit a shower within a proposed detached <br />accessory building was also granted. <br /> <br />The Council adopted Resolution 6833 reaffirming the original approvals and the approval date, yet <br />allowing for the new owners’ signatures (William & Kathleen Wanner) so it could be properly <br />recorded. Due to the expiration timing, the approvals granted via Resolution No. 6833 were extended <br />administratively shortly thereafter resulting in a new expiration date of May 8, 2019. <br /> <br />The Wanners have been developing plans to build a new home on the property for over a year. They <br />had an emergency regarding their home in another state which took their focus away from the <br />Ferndale Road project. They are requesting the Council consider extending Resolution No. 6833 one <br />more year per the terms of the prior approvals. This request was received on May 1st, prior to the May <br />8th expiration. <br /> <br />4. Staff Recommendation. There have been no substantive Code changes which affect this project <br />since the original approvals. Staff recommends approval of the owner’s request for a one-year <br />extension of the approvals granted via Resolution No. 6833. A draft approval resolution has been <br />provided for Council’s consideration. <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to adopt or amend the extension resolution. <br /> <br />Exhibits <br />A.
