This application is regarding variances to rebuild/reorient patio hardcover within the <br />75-foot setback. <br /> <br />2. MN§15.99 Application Deadline. The application was received and was considered to be <br />complete on March 20, 2019. Therefore the 60-Day review period expires on May 19, 2019. <br /> <br />3. Background/ Summary. The existing lakeside patio of the home was constructed over a <br />basement level well room; the cap to the well room is leaking and the owner needs to repair the <br />area. Since the existing patio needs to be removed to conduct the repairs, the applicant proposes <br />a reconfiguration of the patio to add landings under new lake side doors, within the required lake <br />yard; variances are necessary. The existing hardcover level will be reduced. <br /> <br />4. Planning Commission Vote and Comment. On April 15th the Planning Commission held a <br />public hearing. Following the public hearing the Planning Commission voted 7 to 0 in favor of a <br />motion to approve the requested variances. <br /> <br />Additionally, the Commission voted 7 to 0 on a second motion to recommend the City Council <br />consider directing staff to explore an ordinance amendment which would allow for the <br />reconfiguration of nonconforming hardcover within the lake yard. <br /> <br />5. Public Comment. No comments from the neighbors were received regarding this application. <br /> <br />6. Staff Recommendation. Staff recommends approval. <br /> <br />COUNCIL ACTION REQUESTED <br />Council should consider a motion to adopt or amend the approval resolution. <br /> <br />Additionally, the Council should consider directing staff to initiate an ordinance amendment regarding <br />reconfiguration of nonconforming hardcover within the 75-foot setback. <br /> <br />Exhibits <br />A.
