V <br /> 2. <br /> In questioning the Stumpf s Tree Service employees about the cutting, (there was no <br /> foreman on the job) they indicated that the trees were cut down late on Monday, <br /> September 8`h. <br /> Jeff asked them how they could possibly have cut down so many trees across the property <br /> line and they responded by stating that they were told which trees to cut down by three <br /> people standing further up on the hill. Those people were identified as Doug, (Stumpf s <br /> foreman), Julia Knight and a third man they could not identify. Jeff asked that the <br /> foreman for the job be called for a meeting with he and Julia as soon as possible. Jeff <br /> requested that no further removal take place until photographs could be taken, which he <br /> did immediately, and then the removal of the downed trees was completed as there was <br /> currently a realtors open house going on at the Bowens and the debris made a poor <br /> impression. <br /> Later that day, about 1:30 PM. Jeff met briefly with Julia and Doug,the Stumpf s <br /> foreman, when he returned to the job. Julia stated that Stumpf s was informed of the three <br /> stakes that mark the property line. Doug stated that they were not informed of the lower <br /> property stake and cut trees that they were instructed to. <br /> It is interesting to note that the underbrush in the area was basically cut along the accurate <br /> property line from the top of the hill to the lakeshore. The sand and beach border stones <br /> clearly mark the Bowen property along with a stake three feet high marking the lower <br /> surveyors post. The canoe was stored on the lower hill ten feet inside the property line. <br /> To cut down tree#9, a 9"45+year old 50 ft. tall Sugar Maple 20 ft. inside the property <br /> line, the Bowen's beach chairs and fire pit had to be moved further into their property so <br /> that the tree could be felled directly on the beach. <br /> It is very difficult to believe that these fifteen trees could have been cut down <br /> "accidentally"as it would have taken several hours to cut and remove this number of <br /> trees. It was obvious by the underbrush cutting that the property line was understood;yet <br /> trees were cut down 20+ft. inside that line at the direction of several people. <br /> This tree removal by your contractor on our property has significantly improved your <br /> view of the lake and consequently, your property value. <br /> This tree removal by your contractor on our property has significantly harmed our <br /> property value and privacy in the following ways: <br /> 1. These trees provided privacy along the North side of our property which is <br /> now gone. <br />
