�ONp CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 6973 <br /> -'ESHG0' <br /> A RESOLUTION APPROVING <br /> A CONDITIONAL USE PERMIT <br /> PURSUANT TO MUNICIPAL ZONING CODE <br /> SECTION 78-305 <br /> AND <br /> AN INTERIM USE PERMIT <br /> PURSUANT TO MUNICIPAL ZONING CODE <br /> SECTION 78-1726 <br /> FILE NO. LA19-000019 <br /> WHEREAS, on March 6, 2019, on behalf of the property owner Brackett Point <br /> Property L.L.C., Christine Lake (hereinafter the "Applicant"), the vice president of Brackett Point <br /> Property LLC, applied for a Land Use application including an Interim Use Permit (hereinafter <br /> the "IUP"); and a Conditional Use Permit (hereinafter the "CUP") for the property addressed 1400 <br /> Bracketts Point Road and legally described as: <br /> Lot 1, Block 2, Southways, Hennepin County, Minnesota (hereinafter the <br /> "Property"); <br /> WHEREAS, the Applicant has made application to the City of Orono for an IUP <br /> pursuant to Orono Municipal Zoning Code Section 78-1726 to allow the export of approximately <br /> 9,500 cubic yards of material from the Property; and disturbance of approximately 5,800 cubic <br /> yards of material within the 75-foot setback to facilitate the construction of a new residence on <br /> the property; and <br /> WHEREAS, the Applicant has made application to the City of Orono for a CUP <br /> pursuant to Orono Municipal Zoning Code Section to permit a guest house on the Property; and <br /> WHEREAS, on April 15, 2019, after published and mailed notice in accordance with <br /> Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br /> time all persons desiring to be heard concerning this application were given the opportunity to <br /> speak thereon; and <br /> WHEREAS, on April 15, 2019, the Planning Commission recommended approval <br /> of the IUP and CUP for the Property; and <br /> WHEREAS, on May 13, 2019, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br />
