The LR-1B district lot area standard is 1.0 acre. On Tonkaview Lane, <br /> the average lot size is 0.83 acre. The range in existing developed lot <br /> � . sizes is 0.39 acre to 1.61 acres. Eleven lots on Tonkaview Lane are <br /> larger than applicant's lot, seven are equal in size or smaller. The <br /> � construction of a new single family residence on the subject property will <br /> not be out of character with the neighborhood. <br /> . C. The applicant has proposed construction of a residence that will meet the <br /> required front, reaz and side setbacks, will meet the lot coverage <br /> limitations and hazdcover limita.tions, and will meet the height limita.tions <br /> � of the zoning code. <br /> D. Due to general concerns about drainage in the neighborhood, it would be <br /> appropriate that the applicant submit and the City approve a grading and <br /> drainage plan prior to issuance of a building permit for the property. <br /> • 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> � by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. . <br /> � 5. The City Council finds that the conditions existing on this properiy are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, �ight, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difFculty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLiTSIO11eTTS, O��R �TD CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a variance � , <br /> to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to pernut the construction of a. <br /> single family residence on the property which is 0.69 acre in area where a 1.0 acre area is <br /> • normally required, subject to the following conditions: <br /> Page 2 of 4 <br />
