O O ti CITY of ORONO RESOLUTION OF THE CITY COUNCIL �kESIiD4' NO. -- 4 9 8 1 WHEREAS,prior to the lot line rearrangement the Westerly Parcel was substandard in lot area and width, and the Easterly Parcel was substandard in area; and after the lot line rearrangement the Westerly Parcel remains substandard in lot area and the Easterly Parcel becomes substandard in width and remains substandard in area. However,the two parcels still meet the intent of the Comprehensive Plan of the City of Orono because no new building sites are created,having no impact on the overall density; and WHEREAS,with the approval of this lot line rearrangement the City Council of the City of Orono grants a lot area variance for the Westerly Parcel and lot area and width variances for the Easterly Parcel. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the lot line rearrangement of the above referenced property by the subdivider as shown on the certificate of survey by Mark S. Gronberg, a licensed surveyor of Gronberg & Associates, dated May 1, 2003, as attached in Exhibit"A", subject to the following conditions: 1. Applicants shall provide a title opinion for the property confirming ownership and encumbrances. 2. Applicants shall dedicate to the public an appropriate drainage and utility easement along the new property line. 3. The aforesaid division shown on the attached Certificate of Survey shall be filed by the City of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on or before November 27, 2003 together with a certified original copy of this resolution. 4. The approval granted by this resolution shall expire if the division has not been filed by the date specified above. In that event,it will be necessary to file a new application with the City of Orono for subdivision review. Page 2 of 3
