NO.41 5 9 2 A RESOLUTION GRANTING A FOURTH ONE-YEAR EXTENSION TO THE EFFECTIVE PERIOD OF PRELIMINARY PLAT APPROVAL ESTABLISHED PER RESOLUTION NO. 5421 - FILE NO. 05-3152 WHEREAS, on February 13, 2006, the City Council of the City of Orono (the "City Council") adopted Resolution No. 5421 granting preliminary plat approval for subdivision of property located at 3500 Watertown Road owned by James D. Mackinnon (the "Owner"); and WHEREAS, Orono Code Section 82-117 establishes that preliminary plat approval is effective for one year from the date of such approval, and failure to file a complete final subdivision application within this time period shall be considered as formal withdrawal of the proposed subdivision; and WHEREAS, the Owner requested a one year extension of the effective period of preliminary plat approval to February 13, 2008 which was granted by the City Council on January 8, 2007 via resolution No. 5564; and WHEREAS, the Owner requested a second one year extension of the effective period of preliminary plat approval to February 13, 2009 which was granted by the City Council on October 8, 2007 via resolution No. 5674; and WHEREAS, the Owner requested a third one year extension of the effective period of preliminary plat approval to February 13, 2010 which was granted by the City Council on October 13, 2009 via resolution No.5778; and WHEREAS, while market conditions and other factors have resulted in delays in preparation of final plat submittals the Owner wishes to continue the development process per the approvals granted in Resolution No. 5421 and has requested a fourth one-year extension of the effective period of preliminary plat approval.
