NO.41 5 9 2 <br /> A RESOLUTION <br /> GRANTING A FOURTH ONE-YEAR EXTENSION <br /> TO THE EFFECTIVE PERIOD <br /> OF PRELIMINARY PLAT APPROVAL <br /> ESTABLISHED PER RESOLUTION NO. 5421 <br /> - FILE NO. 05-3152 <br /> WHEREAS, on February 13, 2006, the City Council of the City of Orono (the <br /> "City Council") adopted Resolution No. 5421 granting preliminary plat approval for subdivision <br /> of property located at 3500 Watertown Road owned by James D. Mackinnon (the "Owner"); <br /> and <br /> WHEREAS, Orono Code Section 82-117 establishes that preliminary plat <br /> approval is effective for one year from the date of such approval, and failure to file a complete <br /> final subdivision application within this time period shall be considered as formal withdrawal of <br /> the proposed subdivision; and <br /> WHEREAS, the Owner requested a one year extension of the effective period of <br /> preliminary plat approval to February 13, 2008 which was granted by the City Council on <br /> January 8, 2007 via resolution No. 5564; and <br /> WHEREAS, the Owner requested a second one year extension of the effective <br /> period of preliminary plat approval to February 13, 2009 which was granted by the City Council <br /> on October 8, 2007 via resolution No. 5674; and <br /> WHEREAS, the Owner requested a third one year extension of the effective period <br /> of preliminary plat approval to February 13, 2010 which was granted by the City Council on <br /> October 13, 2009 via resolution No.5778; and <br /> WHEREAS, while market conditions and other factors have resulted in delays in <br /> preparation of final plat submittals the Owner wishes to continue the development process per <br /> the approvals granted in Resolution No. 5421 and has requested a fourth one-year extension of <br /> the effective period of preliminary plat approval. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br /> Orono, Minnesota, as follows: <br /> Page 1 of 2 <br />
