In reviewing the survey it appears your plan is to expand a new portion of the <br /> driveway consistent with the existing driveway. According to City Code Section 78-967(b)(3) no <br /> grading or alterations within 5 feet of the property line. A copy of the code section is attached. <br /> Attached is a copy of the survey showing the approved driveway location at the time of the home's <br /> construction in 1994; there was no as-built survey requirement at that time. This proposal reflects a <br /> driveway 5 feet off of the property line; it appears from the submitted survey the existing driveway was <br /> not constructed according to the approved plans and was built right up to the adjacent property line. <br /> Ideally, the City would prefer the existing driveway to be modified so that it conforms to the required, <br /> 5-foot setback. However, while the existing driveway will be allowed to remain as it exists; the new <br /> expansion cannot be approved in a nonconforming area. <br /> Please revise the plans to reflect the proposed driveway 5 feet from the property line and submit the <br /> information so our plan review can continue.
