Mabusth <br /> Zoning Administrator <br /> DATE: April 4 , 1:84 <br /> SUBJECT: #821 Scott McLain, 225 Tonka Avenue <br /> vacation of the westerly 100 feet of Brook Street <br /> as platted in Bayside Addition to Lake Minnetonka <br /> 'OWING DISTRICT - LR-IA <br /> APPLICATION - Vacation of an unimproved platted road <br /> In the process of selling their home on Tonka Avenue, the <br /> McLain 's discovered that their residence encroached 4 feet <br /> in the right or way of Brook Street and their garage (14 feet x <br /> 18 feet) extended 14 feet into Brook Street. It would not be <br /> feasible for the owner to move the structures and the property <br /> in its present state is impossible to sell. In order to clear <br /> the title on their property, the applicants request the vacation <br /> of a portion of Brook Street. <br /> The applicant ' s attorney certifies that Brook Street was platted <br /> on Marc; 1 , 1912 and that the subdividers and owners owned all <br /> OIL the land contained within the plat and that no portion of <br /> Brook Street i:as ever been vacated, conveyed, or otherwise trans- <br /> ferred. <br /> Upon vacation the entire 20 feet wide platted right of way will <br /> revert back to the adjacent lot (lots 1 and 2, block 3 , Bayside <br /> Addition to Lake Minnetonka) . <br /> The applicants have asked that only the westerly 100 feet of <br /> Brook Street be vacated leaving a. 25!-plu5 foot platted access <br /> corridor Oust to the east of the intersection of Tonka and Brook <br /> for the property to the immediate north. <br /> St�lff saes no problem with the proposed vacation as the City has <br /> ro :>1,.lns to improve the platted right of way.
