Page 2 <br /> STATEMENT OF PROBABLE CAUSE <br /> The Complainant states that the following facts establish probable cause: <br /> Your complainant is an Planning and Zoning Coordinator for the City of Orono. The <br /> condition of the property located at 3725 Togo Road, in the City of Orono, County of <br /> Hennepin, and State of Minnesota ("Subject Property") , was identified as having City <br /> Code violations that needed to be corrected. City records reveal that the Subject <br /> Property is owned by JAMES LEROY BARTH, DOB: 03/15/1965, the defendant above-named. <br /> The Subject Property is zoned residential. <br /> On May 25, 2010 the City performed an inspection of the Subject Property and <br /> observed exterior storage of miscellaneous materials and debris such as lumber, <br /> scrap metals, ladders, tires, rims, metal shelving, garbage bags, 5-gallon buckets, <br /> tarps, furniture, utility trailers, miscellaneous construction debris, junk and a <br /> Ford L800 Diesel vehicle with expired registration. (Photos were taken. ) <br /> On June 1, 2010 a code enforcement letter was sent to the defendant outlining the <br /> violations on the subject property and establishing a compliance date of June 17, <br /> 2010. <br /> On June 22, 2010 the City re-inspected the Subject Property and observed that the <br /> aformentioned violations had not been corrected. (Additional photos were taken. ) <br /> On July 12, 2010 the Orono City Attorney's office mailed a correction letter to the <br /> defendant establishing a compliance date of July 30, 2010. <br /> On August 4, 2010 the City made a final inspection of the Subject Property and <br /> observed that the aforementioned violations had not been corrected. In addition, <br /> the City observed that the condition of the Subject Property had become worse. <br /> Additional items observed were items such as a wooden gate, an appliance, a battery, <br /> and a carpet remnant. <br />
