REGULAR CITY COUNCIL MEETING HELD APRIL 8, 1991 <br />($7)ZONING FILE $1624 - CARLSON /SHORELINE MARINA CONTINUED <br />building and landscape plans. I.1 my opinion, the physical aspect <br />of the building should be separate from the use of the property. <br />I think Mr. Carlson should be given approval to build the <br />structure as he is proposing, and the City should establish a <br />licensing procedure to review the other issues on an annual <br />basis. No matter how careful we are to consider all aspects of <br />this operation, something else will arise between now and this <br />time next year. I think we need to have a process where issues <br />can be addressed as they surface. I am in total agreement with <br />Councilmember Callahan. We need to be concerned about the issues <br />involved with all of the marinas in Orono, not only this one. I <br />do not know how the City can monitor these issues if we are no-IC <br />licensing marinas." <br />Barrett advised that Subdivision 8 of the B -2, Lakeshore <br />Business District, includes performance standards that a <br />lakeshore business must meet. He said, "One. of those <br />requirements is that the maximum hours for operation shall be <br />7:00 a.m. to 1J:00 p-m. for retail sales and service functions. <br />If it is determined that making a facility available to club <br />members for meetings or entertainment constitutes a service <br />function, then it would be required to comply with those hours." <br />Council agreed that the land issues, m:_nus the gas tank, <br />should be addressed separately from the use issues, which should <br />be addressed through a licensing process. <br />Jabbour stated that Mr. Carlson should be aware of the <br />concerns raised by Council t11is evening that have yet to be <br />addressed, so that he may take those into consideration when <br />making improvements to the property. Jabbour said, "I do not <br />want Mr. Carlson to make substantial improvements and financial <br />commitments to the property thinking that the City Council has <br />approved, or will not restrict, the manner in which the facility <br />operates. Tie operation has not yet been defined." <br />Goetten concurred with Jabbour. <br />.lames MacKinnon, Attorney for Shoreline Marina & Yacht Club, <br />asked if Council would take whatever action necessary at this <br />point so that t-ie construction process could begin immediately. <br />:ie also cautioned Council about the possibility of setting <br />restrictions which may only pose more problems. He said, "If <br />someone is having a party in the clubhouse, and they wish to do <br />so late into the evening, they are likely to go to their boa` to <br />party once the clubhouse closes. I would think it better to have <br />the party going on inside, rather than on a docked boat." <br />Butler asked how the City regulates the gazebo at the <br />Windward Marine, which, in- her opinion, serves the same purpose <br />and the proposed clubhouse here. <br />- 7 - <br />
