ORONO COUNCIL MEETING HELD JANUARY 28, 1991 <br />STREET CONVERSION ORDINANCE CONTINUED - <br />Mr. Wear if the City allowed the road to remain private, yet <br />permitted certain people to cross the road for access purposes, <br />because it would then be Mr. Wear's responsibility to continue <br />maintaining the road. <br />Barrett agreed, stating that the City had passed an <br />Ordinance in that regard last summer. <br />It was moved by Callahan, seconded by Mayor Peterson, to <br />adopt Ordinance #92, Second Series, declaring Wear Lane and Wear <br />Circle public streets and that upon publication, Wear Lane North <br />and Wear Circle will be maintained by the City. Motion, Ayes--4, <br />Nays -0. Motion passed. <br />LMCD COMPREHENSIVE PLAN AND SHORELAND REGULATIONS <br />Bernhardson presented Council with updated information <br />regarding the LMCD's progress with their Comprehensive Plan. <br />Goetten stated that she was appreciative of the information <br />provided by Councilmembers Jabbour and Callahan. <br />Callahan said, "I believe there are still things to be done. <br />The Metropolitan Council indicated to us that it is essential for <br />the various communities :o get control of the LMCD <br />representatives. The City of Orono does not have that problem, <br />but unless we can get the other cities with a problem over that <br />hurdle the Plan will be ineffective. The LMCD has been stating <br />that the Metropolitan Council has no authority over the Plan. <br />However, the Metropolitan Council does not share that view. Met <br />Council is saying that they have the power to stop implementation <br />of the Plan entirely, as wall as any changes the LMCD may <br />propose. There seems to be a discrepancy." <br />Jabbour was concerned that the LMCD had elected to allow <br />only a.90 -day review period of the Plan, yet the cities had <br />requested the Metropolitan Council to allow six months. <br />Bernhardson stated that the time period will in fact be 90 <br />days. He said, "It may be possible to have that period extended <br />for another 90 days." <br />Jabbour said, "It is my understanding that if the LMCD does <br />not get a consensus, the Plan will then be sent to the <br />legislators." <br />Callahan replied, "That is what has been said, but I'm not <br />sure what they will do." <br />Jabbour stated that,he does not wish to have the legislature <br />involved with Lake Minnetonka. <br />
