ORONO COUNCIL MEETING HELD JANUARY 14, 1991 <br />LMCD SHORELAND REGULATIONS CONTINUED <br />Councilmember Jabbour said, "Even though we are one of the <br />eight cities, I believe Orono is approaching this from an <br />entirely different aspect. As Mark mentioned before, our <br />alliance with the other cities is likely to.fall apart because of <br />our differences. Spring Park would probably like to see a more <br />liberal approach taken with regard to lake conservation. Orono <br />is much more conservative and would like to see more restrictive <br />regulations. I do not believe it is necessary to have another <br />body of government with levying authority to monitor what we have <br />been doing here for some time. However, at the same time, it may <br />be necessary to have such an agency monitoring other cities which <br />have not been as conscientious about protecting Lake Minnetonka. <br />Callahan agreed with Jabbour's comments. <br />Jabbour said, "I am also concerned about specific language <br />in the Statutes which require us to obtain approval from the <br />adjacent municipality if we divert- from the boiler -plate <br />language. I would like to have a legal opinion of that. I would <br />not want the LMCD to become involved with trying to resolve <br />differences between ourselves and our neighboring cities." <br />Callahan said, "I agree, we would not want the LMCD <br />performing that kind of function. In listening to this <br />discussion, I recollected something that was said by the Mayor of <br />Tonka Bay. He stated that all of the lake communities have been <br />trying to do a good job of taking care of the lake. The rules <br />and regulations that each city established for taking care of the <br />lake are embodied in the Comprehensive Plans for each city. Each <br />city was required to submit their Comprehensive Plans to the Met <br />Council for approval. It is quite possible that it will be <br />necessary to amend those Plans in order to adopt what the DNR <br />wants. I believe we should try to get some protection from the <br />Metropolitan Council since they approved all of these <br />Comprehensive-.Plans. It may also be helpful in addressing the <br />concerns expressed by Councilmember Jabbour." <br />Jabbour said, "It is my understanding that before the LMCD <br />Plan can be adopted it is necessary for Gen Olson and Steve Smith <br />to introduce legislation giving the LMCD the ability to levy <br />against properties. Gen Olson has indicated that she does not <br />support that, but I've not heard Mr.. Smith's opinion." <br />Callahan stated that he would be willing to attend a meeting <br />with LMCD representatives if such a meeting is scheduled. <br />Jabbour stated that he too would attend the meeting. <br />Mayor Peterson asked whether JoEllen Hurr would be asked to <br />attend the meeting. <br />
