MINUTES OF THE REGULAR ORONO CITY COUNCIL MEETING <br />HELD NOVEMBER 22, 1993 • <br />POLICE CHIEF REPORT <br />The Police Chief was not present. <br />( * #3) #1842 TOM AND SHEILA BROWNE, 760 SOUTH BROWN ROAD - REQUEST <br />TO MODIFY APPROVED DEVELOPMENT PLAN <br />It was moved by Jabbour, seconded by Goetten, to approve the amended plans for the current <br />building permit application for Tom and Sheila Browne, 760 South Brown Road. Ayes 5, nays <br />0. <br />( #4) #1860 ZELMA McKINNEY, 3599 LIVINGSTON AVENUE - CONTINUATION OF <br />REVIEW OF CONDITIONAL USE PERMIT APPLICATION <br />Mayor Callahan explained that Council was to consider whether a driveway should be accessed <br />off of Blaine Avenue or Livingston Avenue. He added that all Councilmembers should have <br />received a letter from the neighbors' attorney expressing the view that the City is not required <br />to grant a conditional use permit. Callahan had asked City Attorney Staunton to review the <br />letter from the Lommen Nelson law firm. City Attorney Staunton reaffirmed his opinion that <br />the City must grant a conditional use permit in this case and the City does not have the ability <br />to add an owner occupied status as a condition of the conditional use. • <br />Callahan stated there were two concerns remaining: <br />1. Has the property been used according to the Code? <br />2. Parking issues. <br />Mabusth explained the two parking options: <br />1. Access from Livingston Avenue with the existing drive to be realigned. <br />Hardcover will be an issue in this option with the addition of two parking stalls. <br />City Engineer Cook commented on drainage in the area stating it would be hard <br />to calculate the overall effect of this small additional amount of hardcover. <br />However, anything done in the area will impact the watershed. <br />2. Creation of a new curb cut off of Blaine Avenue. The 15' street setback would <br />allow parking at 15'. Backing out onto Blaine Avenue would result. Additional <br />land alterations would be required according to the City Engineer. City Engineer <br />Cook added that a "daylight area" would need to be created to the north and that <br />clear visibility would have to be maintained involving the neighbor to the south. <br />He stated this access could be made safe but there would be significant impact on <br />the property. <br />2 S <br />
