MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON JUNE 12,1995 <br />( #10 - #2022 Robert Melamed - Continued) <br />• Kelley asked for the pros and cons on leaving the road unpaved. Flint said the issue <br />wasn't discussed by the Park Commission but by the Planning Commission. Flint did say <br />that he recommended no paving as this would change the park environment. Kelley <br />commented that cars would park on the grass at Norenberg Park, and this did not change <br />that park's characteristics. <br />Jabbour asked Peterson why the Planning Commission recommended a variance. <br />Peterson said it was a common sense issue that prevailed. He cited the example of the <br />City granting itself a variance in the past with regards to the Crystal Bay post office <br />parking lot. A setback variance was required in order to preserve the park area but no <br />hardship was defined. <br />Jabbour moved, Goetten seconded, to allow access offthe City road with no upgrade or <br />cul -de -sac, noting the hardship to preserve the park area. Kelley asked that the condition <br />be stipulated that the first few feet into each driveway be paved. The motion was <br />amended that the blacktop be installed to City Engineer's standards past the entrance of <br />the shared drive to the discretion of the City Engineer and Staff. Ayes 4, Nays 1, <br />Jabbour. <br />Jabbour moved, Hurr seconded, to allow the applicant to dredge and expand a retention <br />area within City property to southeast to be used to mitigation area for bike trail and <br />• remainder to be banked by City for the future outlot B. The alteration of the designated <br />wetland within the plat will offset mitigation needs of the internal development. Ayes 5, <br />Nays 0. <br />Melamed was informed that he is able to file for final plat approval at this time. <br />• <br />The Council adopted Resolution #3570 as amended above. See vote under each item. <br />MAYOR/COUNCIL REPORT <br />Hurr reported her absence at the next meeting of the Council. <br />Hurr inquired if a public information meeting will be held for the persons living in the <br />Bracketts Point area regarding road improvements to CoRd 15. No date was set. <br />Jabbour reported that he was informed by Tom VanDunn that the state legislature passed <br />the bill regarding the sale of a piece of land on Maxwell Bay back to the public by the <br />DNR. The governor has signed the bill. An appraisal of the property will be conducted, <br />and the land will then be offered for sale to all government agencies. The land would <br />then go to public auction, if necessary. <br />21 <br />
