4 � I, <br />ORONO COUNCIL MEETING HELD NOVEMBER 13, 1990 <br />APPROVAL OF MINUTES* • <br />It was moved by Peterson., seconded by Goetten, to approve <br />the minutes of the Regular Council Meeting held October 22, 199'0. <br />Motion, Ayes -4, Nays -0, Motion passed. <br />APPROVAL OF MINUTES* <br />It was moved by Peterson, seconded by Goetten, to approve <br />the minutes of the Canvassing Board Meeting held November 8, <br />1990. Motion,-Ayes-4, Nays -0. Motion passed. <br />PUBLIC COMMENTS: <br />City Administrator Bernhardson informed Council that Mrs. <br />Ruth Knox was present this evening. He referred to a memo he had <br />prepared regarding the City's policy on survey requirements for <br />building permits. He said, "In this case, the addition to the <br />principal structure appears to be out of the setback areas. <br />However, we have no survey to verify that. Mrs. Knox is asking <br />the City to waive the requirement for a survey. Staff has not <br />asked for a full survey of the entire lot, but rather a <br />verification survey showing only the proposed addition in <br />relation to the setback lines. The City has only amended the <br />survey requirement once, and that was in 1986 for accessory <br />structures meeting certain criteria." <br />Mrs. Knox explained that she was unaware of the need for a <br />survey. She said, "My contractor was taking care of everything <br />and did not realize that a survey was required when he applied . <br />for the permit. I am hoping to have the footings installed <br />before the frost gets too deep. I live on two acres and have <br />brought my nearest neighbor with me this evening. She has no <br />objections to what I am proposing. The existing porch is being <br />enlarged toward the back yard." <br />Acting Mayor Callahan suggested that Mrs. Knox could be <br />allowed to proceed with the footing installation while a survey <br />is being prepared. He said, "However, if the survey indicates <br />that the footings do not meet the required setbacks, your <br />contractor will have to relocate them." <br />Mrs. Knox stated that she would agree to such an <br />arrangement. <br />Goetten stated that she agreed with Acting Mayor Callahan's <br />suggestion. <br />Peterson asked whether it would be necessary to establish a <br />specific date by which a survey must be submitted. <br />Mrs. Knox said, "It is my intention to have the entire lot <br />surveyed. That will take some time. I would appreciate it if I <br />could submit the survey in the spring. If anything is placed <br />incorrectly, I will move it." • <br />- 2 - <br />
